First Issue of Let’s Mediate – The Official Newsletter of Mediation in Motion NPO

We at de Wet Leitch Hands Inc believe that most, if not all, disputes are able to be resolved
through mediation between the parties.

Mediation is a process which entails the engagement between disputing parties whereby they
come together, with the aid of a neutral mediator, with a view to solving the disputes between
them by mutual agreement. Mediation is a method of dispute resolution which can be used
instead of resorting to litigation.

Mediation has a number of important advantages over litigation:

  1. Everything that happens in a mediation is done by agreement. This means that the
    process is far less adversarial than litigation.
  2. The form that the mediation takes is decided by agreement between the parties. This
    means that a mediation can be tailored to the needs of the parties without having to stick
    to the formalistic rules of litigation.
  3. There are no prescribed rules relating to time periods and the filing of documents. This
    means that mediation can occur far more quickly and efficiently than the drawn-out
    process of bringing a matter to court – which can take years.
  4. Because it is a far less time-consuming process, mediation is invariably a cheaper
    alternative to litigation.
